FCA commences High Court proceedings against Digital Wealth, Outsourcing Express and their directors

The UK's Financial Conduct Authority has taken Samuel Golding, Shantelle Golding and two of their companies, Digital Wealth Ltd and Outsourcing Express Ltd, to court.

Samuel Golding is a director of the former company (nature of business: business and domestic software development; incorporated 8 December 2016); Shantelle Golding of the latter (nature of business: management consultancy activities other than financial management; incorporated on 13 June 2016). The FCA wants the High Court to declare that they and their firms have contravened, or have been knowingly concerned in contraventions of, ss19 and 21 Financial Services and Markets Act 2000. Section 19 prohibits anyone from performing any activity in the UK that requires regulatory authorisation without such authorisation; s21 places restrictions on financial promotions.

The FCA also seeks a restitution order against the defendants in accordance with s382, ordering the orderly return of consumers' funds and holding the defendants liable to pay any shortfall in those funds, together with an injunction in accordance with s380, restraining the defendants from future contraventions.
